If I was arrested on a misdemeanor law for playing music on a public street can my instrument be kept until my court date thus preventing me from supporting my family? I have been arrested for this several times and case has always been overturned by the court.

YES. Any object used as a part of an alledged crime can be held until the case is concluded. Your best bet is to: 1.) play somewhere else, 2.) have more than one instrument, 3.) get an attorney to make a motion for the return of property because of hardship, and as a condition of release not to return to the area and play.
