Misdemeanor ''Petty theft''

I was caught in Icings store in the mall stealing two pairs of earrings that amounted to $15. The store pressed charges, but I was not arrested. I cooperated, and I was just given a date to go to the courthouse, two weeks from now. This is my first and only offense, I have no prior criminal record. I'm so afraid I'll get put in jail, since I know little about the court system. Everyone else says I'll probably just get a fine and community service for this. Can anyone tell me what will happen to me?

To better answer your question I would need some more information like: the county where the case is pending, the Judge assigned to the case, and what the store want's to see happen to you.

Generally speaking, you may be eligible for a "Diversion" or "pre-trial" program.

If you were accepted into this program you would most likely be given a certain amount of community service hours (or similar sentence) and after the completion of the program the state would dismiss the charges against you.

Admittance into this program is not guaranteed so I would consult an attorney; because of your lack of criminal history the prices should be reasonable.

It sounds like you will be charged with a 2nd degree misdemeanor, which is punishable up to 60 days in jail. Often times, first time offenders are sentenced to a "shoplifting prevention class", community service & ordered to pay costs as conditions of probation. However, what happens in your case can very depending on the judge or the state attorney where you are located. Good luck!
