Legal Question in Criminal Law in Florida

Misdemenor Arrest

My friend was arrested in Orange County, Florida for public urination and resisting without violence. He is saying that he wants to plead no contest just to put it all behind him, but I'm afraid with the plea on his record he'll have trouble returning to college and finding employment later. With it being his first offence can he plead no contest without adjucation? If not what is the maximum penalty for these misdemenors? Thank you.

Re: Misdemenor Arrest

He could probably plead no contest and have adjudication withheld. He also could probably enter the diversion program and keep everything but the arrest off his record. Later, he may be able to have the whole thing sealed. Otherwise, you are correct in that it may affect his future.

He faces up to 60 days and $500 plus court costs for the urination charge and up to one year and $1,000 plus court costs on the resisting charge.

He should certainly find a lawyer.

I would suggest hiring an attorney; as attorney could likely geotiate a possible dismissal of teh charges.

I handle Orange County cases, so if you are interested, please call me for a consultation.
