Legal Question in Criminal Law in Florida
modification
husband on drug court/house arrest/probation, July 2003. New charge 2004, dismissed. New charge December 2005, two counts of VOP, 1) not reporting change of address 2) grand theft charge $700. Two weeks ago, Judge found him guilty on both counts and sentenced him to 18 months state prison with 139 days credit. What may happen to him when he goes to court on the new charge?? He has a private attorney, but not a very good one!!! Also, he wants to file a modification of sentencing for the prison sentence, what are his chances? Please advise.

I would say his chances are zero on a modification. Judges dont change their senence. I imagine they will add more time to the sentence or run it concurrent.
