Legal Question in Criminal Law in Florida
my mom got caught an item from a theme park in orlando, fl. at no time when they had her in their office did they say they were placing her under arrest, in fact, they said they were NOT prosecuting, rather, she would be receiving some "civil" something or other, nor did they read her her miranda rights or advise her that she did not have to talk. They questioned her for over an hour, drilling her over and over again, accusing her of taking other items, even though they found nothing on her. Its been almost 2 weeks now.. can they come back on her and prosecute

They can come back and press charges against your mom, she needs to speak with a lawyer at once.
