Legal Question in Criminal Law in Florida
motion for new trial
my question is, is it unusual for a person to be sentenced when there is a motion for new trial pending? the attorney asked that the motion not be ruled on at the time of sentencing, it has sat in the courts ever since. 15 months now. shouldnt the sentencing have been continued until the attorney was ready for the motion to be ruled on? please help.

that is unusual. however, motions for new trial or almost never granted. i wouldnt hold my breath waiting fornit.
