If there are new grounds on which to file a Motion to Vacate, such as newly discovered evidence, or a recanting witness, then yes you can file another Motion to Vacate. If you would like to discuss the situation in greater depth, please do not hesitate to contact me at your convenience. You can e-mail me at [email protected] or call me at 813-839-1300.
Thank you and good luck.
