Legal Question in Criminal Law in Florida

mypsace

The alleged victim in our case, has a pretty incriminating myspace page. Are there ways to subponea records from myspace, or are there laws for that? My attorney has never dealt with this before?

Re: mypsace

As a prosecutor, I routinely wrote search warrants for the photos, chatlogs, messages, etc., off of Defendant's MySpace accounts. There is a procedure for issuing a subpoena, but that only gets you a limited amount of subscriber information. For the good stuff, you'll need a search warrant.

Have your attorney contact me if he/she needs further information.

Good luck.
