''NOLLE PROSEQUI'' Does this show up on a Background check?
I was put on Pre Trial diversion for Petty Theft I had to pay supervision payments and take an 8 hour theft class. A week before I finished pretrial diversion I mailed in my certificate of complettion of the class and my last payment. They didn't receive it in the mail so they revoke my PTD and took me to court to prosecute. My Public Defender told me if I just paid those fines agian and show that I did complete the class during the time I was supposed to complete they would drop the case and erase it off my record like it never excisted there so I went to court showed them the certificate and paid them the money. But for some reason it shows up on my public record on the website as NOLLE PROSEQUI. Will this still show up on my background check if an employer runs it? Because I called my PD office and they tell me no it's cleared off your record but they really don't seem to give to craps about me nothing they say really asures me. What can I do to get this removed if it's on or how can I find out if it shows up on my record without paying a lot of money out of my pocket.

Yes it will continue to show on your record. A dismissal will continue to show on a criminal record until the charge has been either sealed or expunged which is a seperate event from a conpletion of a PTGD program. the nol pros will remain visible in a record search. the pd is wrong when they tell you it will be erased. you should get the case expunged, and once that is done it will not show up on a record search. All My Best, Joe Vredevelt from The Cochran Firm 305.670.3119.
