Nolle Prosequi

Whn i was 17 i was charged with felony posession of a deadly weapon in a school area. I entered into arbitration, and the3 case was Nolle Prosequied. Am i a Felon?

No. Under those facts, you are not a felon. If you were charged as a juvenile, the worst that could have happended is that you would have been "adjudicated delinquent." Unless you were charged AND convicted in adult court, you are NOT a felon.

Nolle Prosequied means that a case is dropped and the state no longer is proceeding with a prosecution. Generally, when people refer to someone as a felon, they are speaking in terms of convicted felon. If the state dropped the charges on a case, that would mean that the case did not result in a conviction. So, the short answer would be no.

An arrest may appear on a criminal instant check that different entities will run for different reasons, but it should show that the case was dropped by the state.

Sometimes when people have arrest listed on an criminal instant check, they will attempt to expunge the record if the law says that they qualify.

No. Your cases were dismissed and therefore, no conviction. You may wish to seek a criminal record sealing or expunction to prevent it from showing up on a background check.
