Legal Question in Criminal Law in Florida
If you were given a notice to appear for petit theft (812.014) at a grocery store for $20.00 & you had a prior record from over 10 years ago in another state for this same crime (but it was expunged from the other state)- What is likely to happen here in FL? I have a friend who was charged for stealing $20.00 dollars worth of groceries & want to know if he will be arrested since he had a prior from several years ago? What is most likely to happen? Can he plead "No contest" and ask for a class to take, so he doesn't go to jail?

He can hire an attorney to help keep him out of jail. A lot depends on how they charge it. Theoretically, a person is facing a felony for a second theft charge. Your friend should get an attorney as soon as possible.
