Legal Question in Criminal Law in Florida
I was never notified of my court date, nor was my bondsman. I checked the clerk's system and it shows that the notice they sent to me was returned unserved. My bondsman was notified only after I failed to appear, a warrant was issued and the bond estreated. What obligation does the court have to notify my of my court date?
1 Answer from Attorneys
The court is only obligated to send notice to the last known address. Are you sure your address is up to date, because that is your responsibilty. If it is, and it didn't get to you, and your bondsman also didn't get notice then you have very good grounds to get the warrant withdrawn and your bondsman can get their money back (although that is between the court and the bondsman). Get yourself an attorney so that you can get the warrant withdrawn right away.
