Legal Question in Criminal Law in Florida

Obstruction of Justice

My 17 year old son was charged with obstruction of justice when he did not move out of the road he was already standing in when the police started to chase after a friend of his. Hew was being questioned at the time, when the friend sped off and they said my son did not move out of the way. At the time of the charge, they told him it was a misdemeanor, put this on the report (I have a copy of), and did not arrest him. Today we have a court date set for Feb. 20 and was told it is a felony. The juvenile officer also said he was arrested, which he was not, and I talked with the officer who wrote the report and he admits he thought it was a misdemeanor and did not arrest him....What do we need to do???

Re: Obstruction of Justice

As long as no violence was involved, obstructing justice is a misdemeanor. You should immediately consult a good criminal lawyer.
