Legal Question in Criminal Law in Florida

second opinion possible fraud charges.

Hello, I need a second opinion. I have deposited checks from my employer into my account. They have found a couple of them, but there are more the have not come across yet. My attorney is saying that I should provide them with all the amounts, date and checks. My previous employer has not filed charges yet. But has not decided. What do I do, give them all the information, and hope the don't file charges or let them find them on their own.

You haven't supplied us with enough information about your case to answer your question. However, if they have a good case against you, and you feel pretty sure they can prove what you've done in a criminal court, then being honest with them now and paying back the money you took may be the best idea. You certainly don't want to risk prison time by not cooperating now if they can prove their case in criminal court later. There is usually no better outcome in a criminal case than making sure charges never get filed.

Just as a general rule, if your lawyer thinks it's a good idea, it's probably a good idea.
