Legal Question in Criminal Law in Florida

Osceola County first appearance judge had paperwork warrant in pasco. Inmates Atty didnt show for the hearing. Inmate said he was there on a vop. Being held since 11/2. Atty filed motion for bond. Judge denied bond. Exwife sent a letter to judge. Judge postponed aka scheduled his hearing for Feb on a misdemeaner vop. The jail manually changed the record from warrant to vop. Why is everyone else in and out on vop but my fiance is not getting a hearing until feb. probation ended 11/28/12. His Atty says he cant force the Judge to move up the hearing. What can we do. He never had a first appearance for the vop. Atty says it doesnt matter. Is that true?
