Legal Question in Criminal Law in Florida

Persciption fraud

My question is my daughter is involved in a custody battle and the dcf got involved and one of the care givers of her children is convinced that one of the children has an infection called mrsa and is insisting that all the children take a perscription medicine for the infection and has been giving the drug to all the children even though they have not been diagnosed with the infection.

my daughter went to court on Friday the 2nd of Dec. and the case worker from dcf gave her a perscription for the medicine in her daughters name and told her that if she wanted to continue to visit her children she would have to fill it and start taking the medicine.

I advised her that is illigal. she said that it is only an lotion, I told that if its not over the counter than its illigal.

thank you for any input you may have

Re: Persciption fraud

She should visit her own doctor and get a script id she needs it or a note indicating its not necessary. Its not perscription fraud exactly.
