Legal Question in Criminal Law in Florida
If a person was never read their Miranda rights and sentence to prison could they be granted a new trial? Because he was an officer but was never read his rights could he get a new trail after (10) ten years?

Miranda rights are only necessary under certain circumstances. If someone had these rights violated, then it could be grounds for a new trial but the more likely scenario is that it was not necessary to read this person those rights.

Not only is Mr. Justice right about the grounds for a new trial, but at this stage it is probably time barred anyway.
