Legal Question in Criminal Law in Florida
If a person works for a doctor and that person receives a bill reduction request from an attorney and the balance the attorney shows is higher than the doctor's bill but if the doctor accepts the reduction most or all of the balance will be paid. Is the doctor or the employee of the doctor committing a crime if the accept the offered amount and does not attempt to correct the mistaken balance? I know someone who does this and their supervisor at the doctor's office even says to call the attorney and make it out like they're doing them a favor but not actually telling them the correct balance so as not to lie. What crime if any is committed here?
1 Answer from Attorneys
This is probably a civil matter if the doctor is willing to accept a lesser amount, and therefore unlikely to be criminal. If the employee is hiding the actual amount from the doctor, then there might be a crime, possibly fraud, embezzlement, but it would depend on the specific facts.
