Legal Question in Criminal Law in Florida

petit theft

i was recently caught with $31.00 worth of items in my purse. this was after i had checked out and paid for some items. i did not think i could afford the others so i put in purse. the store called the local police dept. who have me a ''ticket'' to go downtown for a court date. I want to know what usually happens at court? I cannot do any community service or work because I am on social security disability and cannot work, am in chronic pain. is just a fine usually given?

Re: petit theft

The "ticket" is a Notice to appear in court for the criminal charge petit of theft. I would have to know more to give you a better idea of what may happen. You could be placed on probation, fined, jailed, etc.

Re: petit theft

One of several things might happen. You may qualify for pre-trial diversion, which is a sort of probation, only the charges are dropped after you complete the program. It involves some classes, and community service. They will accommodate your disability.

If you don't qualify for PTD, or you do not want it, they may offer you a withhold of adjudication, and the case will be disposed. The only difference is that with a withhold, the case will appear on your criminal record.

Please give me a call if you have any other questions.
