petit theft

my son was 18 when he was charged with petit theft. He was not arrested. The policeman gave him a paper and figerprint his thumb. Can this show up on a check background. He completed a program and they dismissed the charges. I requested a criminal background of him by FDLE Criminal History and did not show this. than you.

Even though your sone was not physically arrested, if the State persued the petit theft charge and if he completed a diversionary program, chances are it will appear on a criminal background check. I'm not sure why FDLE's background check did not show the record. Was his case already dismissed at the point that you ordered the FDLE record? Since the charge was eventually dropped, he would be eligible to have his record expunged.
