Legal Question in Criminal Law in Florida

petit theft

My son was recently arrested for shoplifting. The problem is he was in the grocery store line eating some of the food he was about to purchase when an officer pulled him out of line and eventually arrested him. He was in a town where there was a big street party and they left him in the back of a police van for 6 hours in chains with no water or opportunity to use the restroom. Is this normal? Why not a notice to appear? He is very worried about this because he is a pre-med student and is concerned about his record. Please advise.

Re: petit theft

Given what you have written I believe your son has a great chance of beating this case prior to trial. It seems that there was no legitimate reason to detain your son. as for holding him in the van, that is normal for the police to do.
