Legal Question in Criminal Law in Florida
Petit Theft at Walmart
I and my wife got caught by Walmart security today (11/30/08). My wife took 2 bottles of vitamin C and 2 toothpastes. Total value is $35. Then Walmart security call the cops and then they give me a criminal report affidavit. They also give another one for my wife. So I think we both are charged with the same crime. To tell the truth I know she put these items in her purse, but because I am not the one who actually took these item should I argue in court that I dont know what she did (in the report it said that I act as a watch out for her to do that) Is there any way I can avoid the penalty for this petit crime. Because I am pursuing career in education so it is really important for me to have a good record. Is it the second degree misdemeanor? Do I and my wife have to go to jail. I am an international student now and my wife stays at home? I am so regretful now. but it is too late. We both don't have any bad record so far. Please help me. Should I find a lawyer to help me?
Thanh a lot!
Dave
