Legal Question in Criminal Law in Florida

Petty deft

A fellow college friend of mine was video taped taking a pager that was left on the counter of an office. A person came a few minutes later asking if anyone had seen their pager, and my friend did not confess. This person who took the pager later discarded it in the restroom because of a guilty conscience. Apparently, the person who lost the pager had filed it missing to the college sheriff. I would just like to know what are the penalities facing this person according to Florida law?

Re: Petty deft

With no priors, this person would probably face probation and some form of a retail theft class, plus restitution and court costs. Or if you raise the proper issues then perhaps a pretrial diversion program could be an option. In one of these programs once certain conditions are met then the entire case is dismissed. Once there is a dismissal then a motion could be made to expunge the arrest record thereby giving this person a clean criminal history. This is ideal if this person is considering a professional career ect... GOOD LUCK!
