Legal Question in Criminal Law in Florida
Phone Conversation
I have a friend that has a 11 year old daughter and the ex husband is calling the daughter and giving her a hard time and sometimes not even remembering that he did it. (possible drug related) If the daughter is on her cell phone with the speaker on that I pay for and in my name and the father is on his cell phone, can I record the conversation with a hand held cassette recorder.

Re: Phone Conversation
Phone calls may not be recorded in Florida unless both parties to the call are aware they are being recorded. Otherwise, it's a third degree felony to record the call, and the recording may not be used as evidence in court.
