In response to your question, I am not aware of any state statute specifying rules for police photo line-ups. However, each police dept. has their regulations and policies for their line-ups. I have not researched this issue, but I am sure CASE law (prior decisions by appellate judges that must be followed in that jurisdiction) will specify certain things that police cannot do or things that are considered errors.

If you or someone you know has a pending case where this is an issue, you can take depositions of the detectives or other members of the sherriff's office and ask about their rules for line-ups. 'Hope this helped. Tom Rosenblum
