Can a picture of a person smoking weed land them in jail

Possibly, but in very limited circumstances. If a person is on probation or pre-trial release then such a picture might lead to a violation, but even then it is hard to say there is sufficient evidence. The picture doesn't necessarily prove what the person is smoking. It definitely would not constitute a new crime. Regardless, it's a bad idea.
