If a Plaintiff and a Defendant both live in different states, who's state would the case be heard in? Does one party get to choose?

You posted this under the criminal forum. If it's a criminal case, it takes place where the crime occurred.

If it's a civil case, it would normally take place where the defendant lives, but it could also take place where the accident happened, where the contract says it will take place, where the property is located, or many other places, depending on the type of lawsuit.
