Legal Question in Criminal Law in Florida
If someone were to plead guilty to a lesser charge, bond out, then violate probation is it legal for them to use the first charge against them during sentencing? Friend was being charged with lewd and lasc but plead guilty to contributing to a minor.

The old charge can not be reinstated against your friend. However, the State Attorney can mention the facts and how they supported the original charge and why the case was resolves to a lesser offense. The violation does not expose anyone to the original charge, but only to the charge pled to or found guilty after trial.
