If you have a plubic defender and want to hire a lawyer can the lawyer get files from the public defender if ithe case is about to go to trial and your not happy with the public Defender

Most certainly yes. If you hire a private attorney then the public defender is obligated to provide all of the discovery/evidence in their possession to your new attorney.
I would caution that if you want to hire a private attorney then you should do it sooner rather than later. If you wait until the last second to hire a private attorney then the judge may not continue the case to give your new lawyer time to prepare. The sooner that you have a new lawyer the sooner they can ask the judge for more time to get ready.
