how many points does a person have to get to go to prison?

44. However, a judge has discretion on any felony. At a certain point, that discretion is limited, but it is still there nonetheless. Furthermore, even though there are more than 44 points, the state can agree to not impose prison or the judge can impose a non-prison sentence if the person meets certain conditions for a downward departure. Of course, any possibility of jail or prison means you need to contact an attorney.
