Legal Question in Criminal Law in Florida
If a police officer responds to an alarm that is set off at a residence (alarm is not tied into 911) and they enter the residence by kicking in the the center of the door to gain entry They find in the house lights and equipment that is used to grow marijuana but no drugs. Do they need a search warrant to go through boxes and drawers looking for drugs . Basically they destroyed the house. They originally came out because the alarm was going off.No one was living in the house it was in the process of being renovated. Is this legal in Florida? Is there specific hours during the day a warrant can be executed?
1 Answer from Attorneys
It is probably legal and usually the warrant will say that the warrant can be executed at reasonable hours but most judges will find just about any hour reasonable.
