Possession of Cannabis and drug paraphernalia

My 18 year old son was present at a house where cannabis and related paraphernalia was found. He and his car were searched with nothing found. However, he was arrested, 3/1/00, and charged with these two offenses. (Tampa, Florida). We, parents, bonded him out ($1000) total bond. He has no prior drug problems.

What is our best recourse?

Your best option is to try to get a deal made with the state attorney to allow your son to take part in a pre-trial intervention program. Most of these programs consist of some probation, and a radom drug test, but ultimately the case would be dropped upon successful completion. OR... you have several defenses open to you in that possession of cannabis/paraph. requires a control aspect. This means that the State must demonstrate that the stuff was his and his alone. Also, there could be other issues that should be raised such as whether the search was valid, whether there was probable cause, and a valid warrant to name just a few. I would suggest that you hire a criminal defense attorney to look over the case before you make any moves. Since this is a misdemeanor a lawyers fee should not be very excesssive, and a typical retainer is normally a few hundred dollars. GOOD LUCK....
