Legal Question in Criminal Law in Florida

Possession of Marijuana under 20 Grams

I was recently stopped for speeding by a sheriff and upon further inspection, he found a bag of marijuana in the car weighing 1.1 grams. He gave me a written arrest and released me ROR. I understand the consequences for my actions, although they aren't the most serious, but would have no problem entering a plea with probation as the likely outcome. I am about to graduate from FSU with a 3.5 have been in trouble years ago but have kept very clean since and was wondering what the best route would be. Do I plea guilty, no contest, not guilty? Also, would a public defender be sufficient to negotiate with the states attorney for probation or is this something I could present to the states attorney at my court date myself? I know it's always better to consult with an attorney, but I am in college about to graduate and very poor. Thanks for your time

Re: Possession of Marijuana under 20 Grams

Regardless of what you plea you need to keep in mind that if you are adjudicated guilty your licence will be suspended for up to 2 years.

Depending on your prior arrests the state may be looking to adjudicate you.

If you truly have no money a public defender may be your only option. If there is any way to scrape up some money I would definately try to find a private attorney; they may be able to find something that could get this whole thing tossed out. If so would save you a lot of hastle when looking for jobs.

Feel free to give me a ring if you have any questions.
