Legal Question in Criminal Law in Florida
pre-employment background check
I was charged with a felony 7 years ago and pled to a misdemeanor of simple battery. the judge witheld ajudication. When a background check was done by a potential employer the felony charge came back and they recinded their offer because they thought I lied to them. What can I do about this? If the judge doesn't find you guilty, why did the check come back that way?

Re: pre-employment background check
That is because when a background check is done it shows what you were originally arrested for as well as what you plead to.
Most likely your employer either (1) did not read the backgound check entirely, (2) the criminal record is not correct and should be corrected, or (3) the employer rejected you because of the original nature of the charge.
You should contact me about sealing the record. That way the employer would never know about the offense.
