Legal Question in Criminal Law in Florida
pre-psi in federal drug charge
Is it possible to have a pre-psi before entering a guilty plea agreement? My fiancee's lawyer is saying that he needs to plea guilty before they can start doing anything. Is it true or is it a trap so he can just finish with this case?(he is currently in fdc)

Re: pre-psi in federal drug charge
Hi:
Generally, there needs to be a conviction of guilty or a guilty plea before a pre sentence investigation is commenced. This report assists the judge in making a determination as to what the sentence should be. However, your lawyer should be able to make some type of determination based upon his knowledge of you husband's criminal past if any, conduct in the community, and the statute and case law that relates to his case, etc.
If you are referring to another meaning for psi please ignore the above.
