Pretrial Diversion Program
I got bonded out of jail yesterday (felony grand theft-3rd degree) and i'm schedule to start the pretrial diversion program tomorrow. There's a drug test that I have to take. If I fail the first drug test,will I be arrested?

It depends how long you were in custody. If you were in for 30 days and test positive, I think you would be rejected ftom diversion because it would be obvious you used drugs yesterday or today.

More likely you will be rejected from the pre trial diversion program and reported to the court. This in turn may result in an arrest at some point in time.
