Legal Question in Criminal Law in Florida
Pretrial Diversion Program on Job Application
I was arrested for misdemeanor
possession of marijuana in leon
county and entered the pretrial
diversion program. I have a job
application that asks if I have ever
had the adjudication of guilt
withheld. Do I have to answer yes?
I never entered a plea or went to a
trial as the diversion program was
offered well before the trial date.

Re: Pretrial Diversion Program on Job Application
Are you sure your case wasn't dropped? Typically, after a diversion program the case is dropped. If not, you likely received a withhold. The withhold will appear on your record, so the honest answer to the question would be yes.
However, I really believe that your case was dropped if you did diversion
