previous time served

Is a person entitled to time served credit for the same offense after violating the terms of thier probation for that offense and is subsequently given addition time for the same offense?

You are entitled to all actual time served in jail or prison. However, a judge or State Attorney can require you waive previous time served on a VOP sentence so long as the previous time served and the VOP sentence do not exceed the statutory maximum.

Another issue, if you previously did time in prison, you are not entitled to gain time that was awarded, because you did not actually serve the days.

You are entitled to all the time served in jail on that charge whenever it was served.
