Legal Question in Criminal Law in Florida
while on probation
while on felony probation, if you get a misdemeanor warrant for your arrest, that was a case of nothing more than bad luck and a over powering police officer, do you always get violated or can your probation officer not violate you if she chooses?

I wouldn't say always, but I would say 99 per cent of the time. Your probabtion officer could choose not to send a violation warrant to the judge, but I've never seen a probation officer exercise any type of discretion by not sending in a warrant for violation.
