By law, a DUI can only be adjudicated guilty. However, Orange County is the one and only county I am aware of that allows a diversion program for qualified first time offenders. Underage drinking is usually "eligible" to be put in a diversion program. However, the state has discretion to not allow that. It is best to get yourself an attorney to get you through this.
