probation violation

How would someone go about getting a court date to take care of a 2 year old violation of probation case for a misdemeanor pdp case in jax.

Hello:

I just read your question...and there is a simple answer! Basically, when someone comes to my office with this situation, I FIRST tell him/her to complete any leftover conditions of probation (such as com. service hours, DUI school or fines, etc.). At the same time, I call the Judge's office and ask the secretary if Judge will give us a court date AND recall the capias (warrant for arrest) right now. Most Judges will cooperate with that request. There are a couple of judges that will give us a court date, but will not recall the capias until we show up in court.

Once we get to the court date, we do not have a hearing on the violation that day. We can enter a plea denying the violation and pass the case for a pretrial or the final hearing. We usually work out a deal that first court date and get rid of the case. But, all cases are different and some are more serious and the court may want further punishment. Usually, probation will be terminated.
