Legal Question in Criminal Law in Florida
probation violation
i was put on probation in october of '08 for driving with a suspended with knowledge. i was place on misdemeanor probation for one year. i was recently arrested for possesion of cannabis and possesion of drug para. my question is, if i were to get early term for the suspended license, would this second charge be a violation still? also, can i get these charges dropped if i have no previous conviction, no arrest record?

If you get the probation terminated, it won't be a violation. But I doubt you can be terminated with a new charge. Your other questions really depend on the facts and need to be answered by an attorney in person.

If you were already granted an early termination of probation, then this would NOT violate you. However, if you are still on probation, these two new charges will most likely violate your probation.
While an attorney would need more information to know if your charges could be "dropped," you may be eligible for a diversionary or PTI program (which would allow you to get your charges dismissed if you completed the program successfully).
