Legal Question in Criminal Law in Florida

Prosecution of perjury

an individual lied under oath to obtain a restraining order

against me(Repeat violence) He lied under oath at a hearing

on the matter. I retained a lawyer, got a rehearing, and

prevailed - the order was dismissed abd overturned. I want

this individual prosecuted for perjury. I believe there is

sufficient evidence to prosecute and convict. How can I best frame the case to the State attorney and what will

he or she be looking for to be able to successfully commence

and prosecute such a case?

Please contact your local sheriff's office or state attorney. Your question is inappropriate subect matter for this forum.

Most of the attorneys on this board are criminal defense attorneys. Consequently, we do not like to help facilitate the prosecution of other individuals.

Re: Prosecution of perjury

I think you will have a tough time "presenting a case" to the State for perjury. If the State is unaware of the case, you can bring it to their attention. Perjury is different thahn a regular victim case like battery or theft. Although you were victimzed by the perjury, the system is really the victim of perjury. The State just isn't going to respond to you as if you were a victim of a personal crime so your desire to prosecute won't really matter to them. You can bring the issue to their attention and give them a list of witnesses to prove their case, but I wouldn't expect an indictment.
