Legal Question in Criminal Law in Florida
I was pulled over and given a PTA for having a dime of in my possessione , all this while driving on an expired license. The police officer tells me he's going to make sure that the case is dismissed. should I still hire a criminal defense attorney? he told me to go to court he would show up and make sure it was dismissed.
1 Answer from Attorneys
Once your are arrested (or issued a notice to appear) the decision to continue with prosecution is in the hands of the State Attorney's office, not the arresting officer. It is probably in your best interest to have legal representation in any criminal case regardless of what an officer has told you.
If your question is referring to only a civil traffic infraction, then they are generally dismissed if the officer does not attend the final hearing.
