Legal Question in Criminal Law in Florida

I was put on probation for a theft charge in which there is $20,000 restitution ordered. My PO told me that I could try and get the restitution converted to a civil lien against me and be taken off of probation. The terms of probation was 15 years or until the restitution is paid off. I filed for a motion to modify probation for the restitution to be converted and go to court next week. They told me I did not need a lawyer so I am flying solo. What are my chances the judge will grant it? And if he does, do the victims still get paid?

It really depends on the judge and your ability to pay it. If you have the ability to pay something, then the judge is unlikely to terminate your probation. I'm sure the reason you got so much probation as opposed to prison is because you or your attorney told them that you would pay off the restitution no matter how long it takes in order to stay out of prison. That all said, you never know. The judge may very well convert it to a lien. Just know that you have an uphill battle so good luck.
