On a felony the state has 175 days from the date of arrest to file charges. If they file after that date, your lawyer will have to file a motion to dismiss. If they file within that time period, then trial will be set unless speedy trial is waived. Three months is not overly unusual so I suggest talking to an attorney to help expedite matters.
