Legal Question in Criminal Law in Florida

My question is I trying to find out how I can get my sons records sealed or expunged. He was charged with a simple battery on a specified official, he has completed all of his requirements and given termination of probation. This is his first and only offense.

I have no problem doing it myself if I could get pointed in the right direction or if I need atty that would be ok too.

First you would have to make sure your son is eligible. Please feel free to visit my website, www.ExpungeRecordFlorida.com, and fill out the free eligibility evaluation form and I can let you know.

After you confirm his eligibility, you can either use an attorney or proceed pro se. The steps you take will differ depending on whether he his eligible to seal or expunge, and if he's eligible to expunge under the special juvenile expungement statute. Before you spend any time or money, you need to make sure he is eligible. He can not have been convicted of this charge or any other charge in his lifetime (even minor misdemeanors or criminal traffic violations). Further, certain batteries are ineligible to be sealed. I have a section on my website link below that may answer some of your questions. I also suggest you get an attorney to do the sealing because the little you spend for an attorney may save in the long run if the court or FDLE denies the application.
