Legal Question in Criminal Law in Florida
ok i have a question for my girlfriend she was on probation for tresspassing and she was never in any trouble at all she completed the probation and was told by probation she was done. once she was done she moved and they sent her a letter saying she had to appear in court to be relieved from probation but since she moved she never got the letter. so she for some reason called the probation officer to make sure everything was good and they said they been trying to get ahold of her and she has a bench warrant now and told her to show up to court monday. now she completed everything fines and all the extra stuff. when we go to court monday what are the things that can happen will she be VOP and booked into the jail then bonded out then back on probation? will she just be booked and then bonded out or will she or could she walk out of the court room on her own monday? what are the options or things that can happen to her so i can be prepared because shes literally scared because this is the only thing on her record?
1 Answer from Attorneys
The first lesson to learn here is that in till she hears words from the judge that her probation is terminated or gets a piece of paper that says the same thing she will always be on probation. As far as the warrant goes it is possible the judge can arrest her, but if the probation officer and the judge agree she may actually hear those words that her probation is terminated. There's no way for an attorney to predict what is going to happen in court however. I would suggest you hire an attorney in your area to be safe.
