Legal Question in Criminal Law in Florida

My question is:

I had a 3rd degree theft felony charged against me back in 2001 and pleaded no contest and had adjudication withheld. Did my community service and later had my record sealed. I am in the process of getting a job at the Orlando airport and they needed to run my finger prints through the FBI to check my background. Can the FBI look into my file and see everything or that I have a file and it is sealed, or see nothing at all.

We always advise our clients that there is no guarantee that sealing your record will protect you from background checks for employment opportunities requiring government security clearance. I would suggest you operate under the presumption that they can & will review the information. I would also encourage you to consider expunging your record, as there is a provision in the statutes that permits you to petition the court to do so after having it sealed. I'd be happy to discuss this with you further.

The federal government maintains different criminal databases than any state. If your record made it into their database, it would accessible for them to view since the state sealing order would not affect them. However, a number of factors govern whether your record actually is in their system or not. I agree with the attorney above - you may want to consider having the record expunged at this point.
