Legal Question in Criminal Law in Florida
I have a question about someone who is already in prison with a 5 year mandatory sentence. Is there anyway or anything that can be done to have the mandatory sentence removed so gain time is possible or if part of his sentence can be on probation or work release?

Generally no. Unless there was an error in sentencing or the person is granted clemency.

Definitely not. The minimum mandatory part of the sentence is what makes it so that he can't get gain time or has probation. Of course if there is something that was done incorrectly and he was sentenced incorrectly then that could potentially be addressed, but none of the facts are included on this post.
